San Antonio Paternity Attorney

Paternity Attorney in San Antonio

When legal fatherhood isn’t established, everything from child support to visitation can stay stuck. Texas doesn’t assume paternity unless the parents are married. That means unmarried fathers may have no legal rights, and mothers may not be able to collect support—unless a court steps in.

At Brandi Wolfe Law, we help parents take action. Whether you need to confirm paternity, dispute a false claim, or sort out custody and support, we guide you through the legal process with clarity and purpose.

Why Paternity Matters

Establishing paternity gives both parents legal standing—and that can open the door to shared parenting time, financial support, or decision-making rights. It also helps protect the child, who may gain:

  • Access to benefits like health insurance or Social Security
  • Medical history from both sides of the family
  • A stable support system with two legal parents

Once paternity is confirmed, the court can issue orders related to custody, child support, and visitation.

How Paternity Is Established in Texas

There are two ways to legally establish paternity in Texas:

1. Voluntary Acknowledgment
Both parents can sign an Acknowledgment of Paternity (AOP), usually at the hospital or later through the state. This is a legally binding document.

2. Court Order
If there’s disagreement, the court may order DNA testing. Once results are in, the judge can issue a legal finding of paternity and move forward with other family law issues.

We represent both mothers and fathers. Our job is to make sure your side of the story is heard—and that the outcome is fair for the child and for you.

What Happens After Paternity Is Confirmed?

Paternity opens the door, but it doesn’t automatically define parenting roles. You’ll still need a court order to set up custody, child support, and visitation.

We help clients:

  • File or respond to suits affecting the parent-child relationship
  • Negotiate parenting plans and financial support
  • Challenge claims based on false information or coercion
  • Update court orders as the child’s needs change

If your case overlaps with modifications or termination of parental rights, we’ll help you understand how each piece fits into the bigger picture.
